explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Any APCA membership, email compilations or other types of lists downloaded from this site are seeded to detect unauthorized use by non members and electronically
tracked to determine if they have been illegally resold or distributed. These lists are registered and protected by copyright, and the APCA reserves all rights under the Copyright Act (17 U.S.C. § 106). User agrees that
they have no right to redistribute or resell this list to any other parties. In the event of an unauthorized resale or redistribution by user of this site, the user agrees to compensate the APCA for any possible damages
to the organization, up to and including attorneys fees, lost revenue of any kind, including potential revenue, and the return of the proceeds from any such sales to outside parties. User agrees that their APCA membership
will be terminated without refund and that they shall immediately destroy any such lists downloaded from the APCA website currently in their possession. User further agrees that if such infringement is found to have been
committed, user will be obligated to present an immediate accounting of all proceeds derived from such copyright infringement, and if any such accounting is found to be in error, user agrees to pay treble damages on ALL such
damages to the APCA for the unauthorized use of the list. User agrees that all legal action will be construed by Louisiana Law and jurisdiction and venue will be placed in the state of Louisiana.
